Terms of Service

Effective July 8, 2026

These terms are an agreement between you and ShapeUp ("we", "us") governing your use of the ShapeUp iOS application and the getshapeup.app website (together, the "Service"). By creating an account or using the Service you agree to these terms. If you do not agree, do not use the Service.

1. What ShapeUp is

ShapeUp is a social fitness app: it counts exercise repetitions using your device's camera, tracks daily steps from Apple Health, and lets you share activity with buddies and groups. It is a motivation tool, not a medical device.

2. Health disclaimer

Exercise involves risk. ShapeUp does not provide medical advice, and its rep counts, goals, and streaks are not a substitute for professional guidance. Consult a physician before beginning any exercise program, stop if you feel pain or discomfort, and exercise within your own limits. You use the Service at your own risk.

3. Your account

• You must be at least 13 years old to use ShapeUp.
• You sign in with Sign in with Apple and are responsible for activity on your account.
• Your username and display name must not impersonate others or be offensive.

4. Subscriptions

ShapeUp requires a paid subscription, billed through your Apple account. Subscriptions renew automatically until cancelled in your App Store settings at least 24 hours before the end of the current period. Prices are shown in the app before purchase. Refunds are handled by Apple under App Store terms.

5. Fair play and acceptable use

• Don't attempt to falsify activity data or manipulate leaderboards outside the app's normal use.
• Don't harass other users, and keep profile and group photos appropriate — no unlawful, hateful, or sexually explicit content.
• Group admins may set group goals and remove members from their groups; we may remove content or accounts that violate these terms.
• Don't attempt to probe, disrupt, or reverse-engineer the Service or access other users' data.

6. Your content

You keep ownership of the photos and other content you upload. You grant us a limited license to store and display that content to the users you share it with, as needed to operate the Service. You are responsible for having the rights to what you upload.

7. Privacy

Our Privacy Policy describes what we collect and how it's used, including that workout video never leaves your device.

8. Termination

You can stop using ShapeUp at any time and request account deletion at mitchharaburda@gmail.com. We may suspend or terminate accounts that violate these terms or misuse the Service. Sections 2, 9, and 10 survive termination.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose. Rep detection depends on camera placement, lighting, and movement, and may miscount; leaderboards and streaks are provided for motivation and are not guaranteed to be accurate or continuously available.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your exercise activity. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the claim arose.

11. Changes to the Service or these terms

We may update the Service and these terms over time. If we make material changes to the terms, we will update this page and the effective date, and call it out in the app. Continuing to use the Service after changes take effect means you accept the new terms.

12. Governing law

These terms are governed by the laws of the United States and the state in which the operator of ShapeUp resides, without regard to conflict-of-law rules.
